DMCA Policy

Fiegel’s Fix-It (“Company,” “we,” “us,” or “our”) respects the intellectual property rights of others and expects users of www.fiegelsfixit.com (the “Site”) to do the same.

This policy complies with the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512.

1. Reporting Copyright Infringement

If you believe that material available on our Site infringes upon a copyright you own or control, you may submit a DMCA Takedown Notice by providing the following information in writing to our designated DMCA Agent:

  1. A physical or electronic signature of the copyright owner or authorized representative

  2. Identification of the copyrighted work claimed to have been infringed

  3. Identification of the material claimed to be infringing and its location on the Site (URL preferred)

  4. Your name, mailing address, phone number, and email address

  5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law

  6. A statement, under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner

3. Response to Takedown Notices

Upon receipt of a valid DMCA notice, we will:

  • Promptly investigate the claim

  • Remove or disable access to the allegedly infringing material

  • Notify the content provider or user responsible for the material, if applicable

4. Counter-Notification Procedure

If you believe material you posted was removed or disabled by mistake or misidentification, you may submit a DMCA Counter-Notification containing:

  1. Your physical or electronic signature

  2. Identification of the material that was removed and its prior location

  3. A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification

  4. Your name, address, telephone number, and email address

  5. A statement consenting to the jurisdiction of the federal court in your judicial district (or your location if outside the United States) and that you will accept service of process from the person who submitted the original DMCA notice

Counter-notifications must be sent to the DMCA Agent listed above.

5. Repeat Infringer Policy

Fiegel’s Fix-It may, in appropriate circumstances and at its sole discretion, disable or terminate access to the Site for users who are repeat infringers of intellectual property rights.

6. False Claims Warning

Under the DMCA, any person who knowingly materially misrepresents that content is infringing or was removed by mistake may be subject to liability, including damages, court costs, and attorney’s fees.

7. No Legal Advice

This DMCA Policy is provided for informational purposes and does not constitute legal advice. If you are unsure whether material infringes copyright, you should consult a qualified attorney.

8. Policy Updates

We reserve the right to modify this DMCA Policy at any time.
